Terms and Conditions

VALIDITY

This quotation is valid for 30 days.

PRICE

Prices quoted are ex-warehouse, exclude GST, and are net and firm, except for variations in rates of exchange.

10% GST is payable on all items quoted, including freight and any other applicable charges.

AVAILABILITY

Items quoted as in stock are available at the time of quotation and are subject to prior sale.

ORDER

Should you wish to place an order as a result of this quotation, please state the relevant quote number to ensure you receive the quoted prices. No credits will be issued if the quote number is not referenced on your order.

EXCHANGE RATE

This quotation is in Australian dollars. A depreciation of 3% or more between the published ANZ Bank sell exchange rates on the day of quotation and the date of invoice shall be applied to the customer’s account. No adjustment in favor of the customer will apply if the prices offered are discounted from list prices at the time of quotation.

EXCHANGE RATE – CONTRACTS & STANDING ORDERS

Should the rolling monthly average exchange rate depreciate 3% or more for longer than one month during the term of the agreement, prices will be recalculated based on the new prevailing exchange rate for the remaining supply under this contract.

PACKING AND HANDLING FEE

A packaging and handling fee will apply to every order unless you nominate your own freight company to ship the order on your account.

DANGEROUS GOODS HANDLING FEE

A Dangerous Goods specialist handling fee will be applied to all orders containing a Dangerous Goods item, charged as a flat fee per order.

SENSITIVE FREIGHT – DELIVERY AND HANDLING CHARGE

A sensitive freight charge may apply to specific equipment requiring special delivery and handling. This service may include dedicated “air-ride” delivery trucks, tailgate unloading, delivery to laboratories, unpacking, and removal of packing material. The additional freight cost will only be applied once per order.

Note: Delivery charges are based on the equipment fitting through all doors, access ways, and lifts. Additional charges will apply if stairway access is required.

DELIVERY TIME

Delivery times quoted are approximate and subject to confirmation upon receipt of your order. Estimated lead times include two additional weeks for transit, customs clearance, and local delivery delays. If you require goods urgently, please contact us to discuss expedited options.

Monthly Credit Account Customers
  • Full payment is required within 30 days from the invoice date unless otherwise quoted.
  • Remittance advice should be sent to: ac******@hu*************.au.
Payment with Order (PWO) & Cash Sales Customers
  • Prepayment is required for non-account (cash sale) customers.
  • Payment methods: Credit Card (Visa, MasterCard) or Direct Deposit (details below).
  • A proforma invoice can be sent upon request.

ORDERS FOR NON-STOCK ITEMS

Any stock procured, ordered, imported, or manufactured at the purchaser’s request (special items) cannot be canceled or returned for credit unless defective.

LICENSES & PERMITS

Purchasing restricted products may require a license or permit from the end-user.

SERVICE SUPPORT

Service support will be offered by external providers based on the equipment supplied or requiring repair.

DELIVERY & SITE PREPARATIONS

Where applicable, equipment will be delivered to the building exterior. Customers are responsible for moving equipment to the final site. Notify us in advance to determine if a Hurst representative is required. The cost of services such as power outlets, air-conditioning, cooling water, drainage, cryogenic liquids, and compressed gases is not included in quoted prices.

COMMISSIONING & TRAINING

Commissioning and training services are available at an additional cost. Prices quoted exclude services such as installation, plumbing, lifting, and specialized connections. Costs for commissioning and training are available upon request.

INSURANCE

Once delivered to the exterior of the building, the customer assumes responsibility for insuring the equipment. Items remaining Hurst’s property after delivery must also be insured until purchase or return.

WARRANTY

The warranty period starts upon delivery or installation (whichever is earlier). It covers material or workmanship defects during the specified period and is in addition to rights provided under Australian law.

Exclusions:

  • Consumables, plasticware, glassware, or normal wear and tear.
  • Damage from misuse, negligence, or failure to follow instructions.
  • Freight damage caused by the customer’s courier.
  • Repairs by unauthorized parties.

WARRANTY AGAINST DEFECTS – COMPLIANCE STATEMENT

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The warranty offered by Hurst is in addition all rights and remedies to which you may be entitled to under the Australian Consumer Law.
